The Law of the Sea : and My Experience

Today im gonna share you about THE LAW OF THE SEA. this is one of discipline in International Relation Studies. This is not my favorite discipline actually :-| i got D special for this subject. But i try not to hated that. :D

That time, i still remember, got sick for a couple month. that un-health condition makes me hard to keep doing the annual routine as i use to be student. 

Short story, I am a kind of person who doesnt like checking my condition in to the doctor. I never been hospital since i was a kid. I have good immunity. And thats mean i never got sick ever.

Then... when i feel disturbed by my unhealth condition, i just ignore the feel.

My family, friend, boyfriend and people around me who saw my pale looks, push me to go to the doctor. but i denial. 

I say, i just need to rest, then i will recover again.

But, that never happen.

I keep feel unhealth, and my activities also disturbed so much. the sick is worst (because i keep it for a month).

Lucky me, in the critical condition..., destiny brought me to the hospital.

For specifically, My uncle (Hendro Ekwarso) put me to the hospital, even i kept stubborn dont want to go there. But he say : "If you really ok, u can go home. simple. nothing to worry".

So, i got to the doctor. We check at the first hospital. then, the doctor diagnose i got "appendicitis" (Usus Buntu), and need to surgeon as soon as possible, because i hold it for too long.

I cant believe that time! i never got to the hospital and now she said that i must got surgery as soon as possible???!!!. what a bullshit!. That time i was shock. and cant believe. I judge her (the doctor) was lying, because she need a money. I left the hospital.

Then tomorrow morning, my sick got worst. i cant move my body. The temperature of my whole body looks like in high rate. 

My Uncle now really push me in to the hospital. I say, i wanna prove the last doctor, so i want to be taken to another hospital.

Then because of my stubborn. i taken to another hospital. 

The doctor diagnose the same thing, when receive my medical test (urine, blood)

Oh Gosh. I want to run away. I kind of person hard to believe another people.

I wouldt entrust my life in to this guy (doctor) hand!

See my sign that i want to run away. My nephew and all of her friends, hold me very tight. I fight and scream. I scare of course. i never been hospital, moreover got surgery!. how if he do wrong procedure, how if i cant wake up anymore? how if the drug not working when they cut my body in to a pcs?.

Without my permission, my uncle signed the approve letter from the doctor. and because i already cant eat for 3 days. So. surgery can do in that time! from next 2 hours.

In that night, i taken to surgery room.

Then wake up in the morning....

still in drug reaction, cant feel my body part, fully paralyzed.

and when i force to wake up, my whole body just like spinning... and got to puke.

strange condition :|

in other side, i can see the intestines their cut, put in to small plastic bottle. looks like fat worm to me.

for 2 weeks got rest in to the hospital. So, cant go to campus, of course. 

Plus, with delaying for very-very-very long time the illness, make me lose lot of learning material. :'(

I want to save my denomination (nilai) the Law of the Sea discipline. I send a letter from the doctor, and also submit the substantiation (bukti), but still cannot acceptable from my lecturer. How wicked :( .

The rest what i only have is...this....

WILAYAH DARATAN

Antara wilayah negara yang satu dengan yang lain jelas batas-batasnya, biasanya ditetapkan berdasar perjanjian mengenai garis batas wilayah yang saling berbatasan. Kedaulatan negara atas wilayah daratan termasuk tanah dibawahnya.

WILAYAH PERAIRAN

1. Berdasarkan Konvensi Hukum Laut ke III (1982) 

•  Negara berpantai (the coastal state)
• Negara tidak berpantai (the land locked states group)
•  Negara secara geografis tidak menguntungkan (the geographically disadvanategd state group)
• Perairan yang berada di luar kedaulatan suatu negara (Zona Tambahan, ZEE, Laut Lepas, Landas Kontinen

2. Perairan yang masuk kedalam wilayah kedaulatan negara : Laut terriorial, 

    dan Perairan pedalaman

APA ITU LAUT TERITORIAL ?

Yaitu bagian laut yang terletak pada sisi luar garis pangkal (base line) dan disebelah luarnya dibatasi oleh garis atau batas luar (outer limit).

Garis pangkal dapat ditentukan melalui beberapa macam:

1. Garis pangkal normal (garis pangkal yang ditarik sewaktu air laut surut dengan mengikuti lekukan-lekukan pantai)
2. Garis Pangkal Kepulauan 
3. Garis Pangkal dari Ujung ke Ujung

• Laut territorial merupakan cikal bakal terbentuknya hukum laut internasional .
• Lebar laut territorial adalah sejauh 12 mil diukur dari garis pangkal.

Syarat hak lintas damai laut territorial (right of innocent passage)

1. Melintasi laut tanpa memasuki perairan pedalaman/ singgah di pelabuhan - pelabuhannya
2. Lintasan tersebut harus tidak terputus dan cepat, kecuali dalam keadaan terpaksa (force mejeure) atau kesulitan
3. Lintasan tersebut harus damai

Perairan pedalaman ???

Yaitu perairan yang berada pada sisi dalam dari garis pangkal.

Pada prinsipnya negara lain tidak boleh melewati perairan ini, tetapi jika perairan pedalaman ini terbentuk karena penarikangaris pangkal dari ujung ke ujung negara lain memiliki hak lintas damai (right of innocent passage), dimana sebelumnya perariran ini adalah laut territorial atau laut lepas.

Negara memiliki kedaulatan terhadap dasar laut dan tanah dibawahnya. Segala sumber daya alam yang terkandung didalamnya adalah menjadi hak dan kedaulatan sepenuhnya dari negara yang bersangkutan.

Zona Tambahan ???

Merupakan zona transisi antara laut lepas dengan laur wilayah.

Zona ini berfungsi untuk mengurangi kontras antara laut wilayah yang rezimnya tunduk seluruhnya pada kedaulatan negara pantai dan laut lepas dimana terdapat rezim kebebasan.

Lebar Zona tambahan?

Pasal 33 ayat (2) Konvensi Hk laut 1982.

Zona tambahan tidak boleh melebihi dari 24 mil laut garis pangkal dari mana lebar laut wilayah diukur. Artinya, negara pantai mula-mula mempunyai kedaulatan atas laut wilayahnya selebar 12 mil dan sesudah itu wewenang-wewenang tertentu atas zona tambahannya selebar 12 mil.

Wewenang Zona Tambahan???

Pasal 3 Konvensi Hk laut 1982.

Negara-negara pantai dapat melaksanakan pengawasan-pengawasan yang perlu untuk mencegah pelanggaran peraturan perundang-undangan bea cukai, fiscal, imigrasi atau saniter di dalam wilayah atau laut teritorialnya.

Pengawasan ini dapat dilengkapi dengan tindakan-tindakan pemberantasan dan negara pantai dapat menghukum para pelanggar peraturan perundang-undangan tersebut.

Zona Ekonomi Eksklusif

• Diperjuangkan dalam forum internasional. Konferensi hukum laut internasional tahun 1974-1982. Bab V Pasal 55-75 Konvensi Hukum laut 1982.
• Pasal 55 -> ZEE merupakan suatu daerah atau area yang terletak di luar atau berdampingan dengan laut teritorial
• Pasal 57 -> ZEE tidak boleh melebihi dari 200 mil laut, diukur dari garis pangkal. Jalur laut selebar 12 mil laut diukur dari garis pangkal adalah laut territorial, jadi lebar ZEE ini adalah 188 (200-12) mil laut.
